Hi, I've been through the EOTAS/AP twice and your info is incorrect on two counts - first professionals say post 16 EVERYONE goes to college but if a YP can't due to medical needs then they can't but still need an education and the LA still has a duty to provide one. If parents hit a brick wall and don't have an EHCP then the YP needs a EHCP. I would expect most YP with EOTAS at 16 to have an EHCP./.. but that could be one reason for parents struggling to get passed the LA policy bs that post 16 all kids go to college. Lets face it if a erson is too ill / can't manage the environment before the turn 16 they are not without something massive happening suddenly going to wake up and be able to cope post 16.
Both my son's have had or have EOTAS agreed for post 16. I was also told the first first it is impossible. But then it turned out there were about 12 other families in the same situation (when the LA replied to a qu and CCed all the other parents in)...So the second mistake is about child benefit - the actual law is that if a child/yp has had HE/ EOTAS during yr 11 and they are studying full time then child benefit continues.
